1. Introduction
Welcome to NexPod. These Terms of Service ('Terms') govern your access to and use of the NexPod podcast hosting and distribution platform ('Service'). By creating an account or using the Service, you agree to be bound by these Terms.
2. Acceptance of Terms
By accessing or using NexPod, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction) and that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
3. Description of Service
NexPod provides tools for podcast creators to host audio and video files, manage shows and episodes, generate RSS feeds compliant with major podcast directory standards, and distribute content to platforms such as Spotify, Apple Podcasts, YouTube Music, and Amazon Music. Submission to third-party platforms is subject to those platforms' own terms and approval processes.
4. User Responsibilities
You are responsible for all content you upload, the accuracy of show metadata, and any activity under your account. You agree to use the Service in compliance with all applicable laws and regulations and not to misuse the platform in ways that could harm NexPod, other users, or third parties.
5. Content Ownership
You retain all ownership rights to the audio, video, artwork, and metadata you upload. By using the Service, you grant NexPod a limited, non-exclusive, worldwide, royalty-free license to host, store, transmit, and deliver your content solely for the purpose of operating and providing the Service to you and your listeners.
6. Prohibited Content
You may not upload or distribute content that is illegal, defamatory, obscene, hateful, infringes copyright or other intellectual property rights, contains malware, or violates the rights of any third party. NexPod reserves the right to remove content and suspend accounts that violate this section.
6a. Content Standards and Restrictions
NexPod is a clean podcast platform. Explicit content is NOT allowed. Explicit content includes: profanity-heavy language; sexual or explicit discussions; graphic violence; hate speech or abusive language; and any content deemed inappropriate at platform discretion. We reserve the right to remove, restrict, or suspend any content or account that violates these standards, at our sole discretion.
6b. AI Content Moderation
Uploaded audio, video, titles, and descriptions may be automatically analyzed by AI moderation systems for compliance with our content standards. Content flagged as severe is blocked from publishing; content flagged as mild requires creator confirmation before going live. Admins may review, restrict, or remove any uploaded content at any time. Use of AI moderation does not transfer ownership of your content to NexPod — you retain all rights to your work, but it must comply with platform standards to be hosted or distributed.
7. Account Terms
You must provide accurate registration information and keep your login credentials confidential. You are responsible for all activity that occurs under your account. Notify us immediately of any unauthorized access. Email verification may be required before accessing certain features.
8. Termination
You may close your account at any time. We may suspend or terminate your access to the Service if you violate these Terms, misuse the platform, or for any reason at our sole discretion. Upon termination, your content may be removed from our servers and your RSS feeds may stop functioning.
9. Limitation of Liability
To the maximum extent permitted by law, NexPod and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, listeners, or goodwill, arising from your use of or inability to use the Service.
10. Disclaimer of Warranties
The Service is provided 'as is' and 'as available' without warranties of any kind, express or implied. NexPod does not warrant that the Service will be uninterrupted, error-free, or free from third-party platform changes that may affect distribution or playback.
11. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email or in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
